PENEGAKAN HUKUM TERHADAP TINDAK PIDANA PENYELUNDUPAN PAKAIAN BEKAS IMPOR “MONZA” (Studi kasus di Kantor Pengawasan dan Pelayanan Bea dan Cukai Tipe Madya Pabean C Teluk Nibung, Kota Tanjung Balai)

The Directorate General of Customs and Excise is an agency that has the authority to carry out the management, supervision and action in the traffic of goods entering and leaving in the customs area. One of the crimes that often occurs is the crime of smuggling of imported used clothing in the area of Tanjung Balai City. The government policy prohibits importing used clothing because it can harm domestic industry and the country's economic income. Besides that, used clothing can cause various kinds of diseases, ranging from skin diseases to HIV so that it has the potential to endanger health in society. This paper aims to find out and understand the law enforcement against the crime of the smuggling of "Monza" imported used clothing as well as the constraint factor of law enforcement against criminal acts of the smuggling of "Monza" imported used clothing in the area of Tanjung Balai City. The method used in this writing is sociological juridical, which is a legal research that uses secondary data for the initial data and followed by primary data or field data and with qualitative descriptive data analysis techniques. The obtained results conclude that law enforcement against criminal act of the smuggling of imported used clothing by the Directorate General of Customs and Excise Teluk Nibung has shown its efforts in overcoming these crimes. The reduced crime of the smuggling of "monza" imported used clothing can be seen from the speculation of data that has decreased from 2016, 2017 and up to the beginning of 2018 until September no one has committed the crime
